Dr Alan Boyd of the Department of Environmantal affairs writes as follows:
Please take note of the following:
1. SANParks issued a filming permit (FPP/1521) for filming on Bird Island over 5 days earlier this month to John Downer Productions.
2. Regarding the recorded incident close to the beach, the DEA was contacted by the Nelson Mandela Bay Metro staff regarding this incident. We have never condoned the chumming activities close to the beach and we have indicated that the Metro should act against this if they have any safety concerns regarding such activities in future.

One expected an eventual response from the DEA but it was surprising even to us that the DEA appears to hold the view that chumming – as per Raggy Charters – is not yet regulated under SA law and that they are considering legislative amendments in order to “regulate this kind of activity in the future”! Do DEA’s managers (and “legal advisers”) need a “dummies guide” on what their laws regulate and prohibit? We and the law-abiding, tax paying citizens of PE would be happy to oblige!
We also note that despite continued requests for copies of the permit(s) issued to Raggy Charters, DEA has not obliged and refuses to even respond to the requests.

Dear Alan
Many thanks for your email. Could you kindly provide me with a copy of the permit you refer to. Based on your email below, it is then clear that Raggy Charters and / or John Downer Productions did not have the requisite legal authority to undertake the filming of sea birds and the chumming in the vicinity of Hobie beach – which is now common cause and have been admitted to by representatives of both parties.
Accordingly, DEA has a legal mandate to commence with legal action against Raggy Charters and John Downer Productions for violating the provisions of, inter alia, the WSCD regulations, the Sea Birds act and the ICM Act. Kindly confirm that the DEA will be enforcing the provisions of these laws.
I await receipt of the permit and the confirmation as requested above.
