UPDATE: On 25 November the decision to appoint Mlokoti was reversed and Acting Municipal Manager, Johann Mettler appointed to the Top Job - See: Dear Municipality – Save R500K and hire me to drive Google for you for the reasons. Criminal Charge Laid Against Former Acting Municipal Manager

On 29 November 2012, the Democratic Alliance laid a criminal charge with the SAPS against the former Acting Municipal Manager of the Nelson Mandela Bay Metropolitan Municipality, Mr. T Hani. The charge was made in terms of Section 173 of the Municipal Finance Management Act 56 of 2003. This section deals with financial misconduct and the onus on accounting officers to inter alia,  combat corruption and implement supply chain management policies. The continued appointment of the acting municipal manager of the Nelson Mandela Bay Metro, Themba Hani, is unlawful from today. Resolution 17 of the metro council, taken in March this year, stated that: "The extended acting appointment period commences on 19th March 2012 and terminates on 18th July 2012 or upon the appointment of a municipal manager, whichever occurs first". The current Municipal Manager of Bitou Municipality (Plettenberg Bay) has been accepted as Municipal Manager of Sundays River Municipality despite being found guilty of financial misconduct. After who knows how long the Municipality has finally advertised the Nelson Mandela Bay Municipal Manager's position. The Acting Municipal Manager position was held since August 2009, by well known Upington actor and Frequent Flyer, Elias Ntoba.
