In response to a notification from Council (See: NMB Council Puts a Damper on MBDA’s 20 Year Celebrations) the MBDA have basically told Council and the City Manager to take a hike and are sticking to their guns.
What this means for citizens is that we can probably expect to see more lawyers driving around town in high end vehicles whilst we fund their new more impressive lifestyles!
The response from the MBDA (attributed to MBDA CEO Anele Qaba) was as follows:
Dear City Manager
1. Your letter dated 23 August 2023, refers.
2. We do not intend to deal with all averments in your letter and failure to do so should not be construed as admission thereof, save for the following:
We would like to draw your attention to the provisions of section 93(D)(2)(a) of the Municipal System Act 32 of 2000 which states the following:
(2) (a) The official lines of communications between a municipal entity and the parent municipality exist between the chairperson of the board of directors of the municipal entity and the mayor or executive mayor. as the case may be, of the parent municipality.
b. That being the case we are therefore of the view that legislation requires that any communication in relation to the Board and the entity from the Shareholder, must come from the office of the Executive Mayor to the Chairperson of the Board as required by the law.
3. To this end, your communication lacks legal legitimacy and therefore the instructions therein remain unlawful.
So – Dear Gary do us all a favour and send the same letter and sign it by yourself. Chop, chop now Mr Mayor, lawyers work on time and petty stuff like lying in bed dreaming about how to squeeze the City out of even greater gobs of cash!
