Coronavirus Lockdown – Step Out of Line and get this Fine:

Determination of Admission of Guilt Fines in Respect of Offences in Terms of the Disaster Management Act Regulations 2020 for Port Elizabeth, Nelson Mandela Bay

Any contravention of these Lockdown Regulations will result in the following fines:

11(1)(a) – Convening of a Gathering, Assembly, Concourse or Processing of more than 100 persons wholly or partially in open air or in a building or premises: R10000.00

11(1)(b) – Permitting of more than 50 persons at a premises where liquor is sold and consumed in contravention of the Disaster Management Act Regulations 2020: R10000.00

11(1)(c) – Hinder, Interfere or obstruct member of SAPS, SANDF or PEACE OFFICER in execution of his/her duties under the Disaster Management Act Regulations 2020: R5000.00

11(4) – Making of a misrepresentation that any person is infected with COVID-19: NO Admission Of Guilt

11(5)(a) – Publishing of any statement to deceive any other person about any Coronavirus: NO Admission Of Guilt

11B(1)(1) – Failure to confine oneself to ones place or residence (FIRST Offence): R2000.00
11B(1)(1) – Failure to confine oneself to ones place or residence (SECOND Offence): NO Admission Of Guilt
11B(1)(1) – Failure to confine oneself to ones place or residence (THIRD Offence): NO Admission Of Guilt

11B(1)(iv) – Movement between Metropolitan and District areas (FIRST Offence): R5000.00
11B(1)(iv) – Movement between Metropolitan and District areas (SECOND Offence): NO Admission Of Guilt
11B(1)(iv) – Movement between Metropolitan and District areas (THIRD Offence): NO Admission Of Guilt

11B(1)(b)-(d) – Failure to close shop or selling prohibited items: R10000.00

11B(4) – Annexure D place or premises not closed: NO Admission Of Guilt

11B(3) – Failure to present permit to perform essential services when so required, alternatively making of a misrepresentation that a person is duly authorised to perform essential services: R2000.00

4 read with 9 and 10 – Public transport facilities failing to provide proper sanitization or hygienic conditions in such facilities (FIRST Offence): R5000.00

S(1)-(7) read with 9 and 10 – Embarkation of public transport passengers in the public transport vehicles. (1) Public tranport vehicles not sanitised before picking up and dropping off passengers. (2) Operators not ensuring that all public transport vehicles door and window handles, arm-rests and hand rails are sanitised before picking up and dropping off passengers. (3) Operators not ensuring taht all public transport vehicles are clean and tidey. (4) All public transport operators not providing disinfection information materials and procedures. (5) Drivers not wearing a mask. (6) A marshall who interacts with members of the public in public transport facilities not wearing a mask. (7) Using improper sanitisers (FIRST Offence): R5000.00 (SECOND Offence): Court

(1) Long distance and inter-provincial services rendered during the lockdown (FIRST Offence): R10000.00. (SECOND Offence): NO Admission Of Guilt
(2) Transportation of passengers by buses – non-essential passengers (FIRST Offence): R10000.00. (SECOND Offence): NO Admission Of Guilt
(3) Public transport that ferry essential services workers outsid ethe hours from 05h00 to 09h00 and again from 16h00 to 20h00 (FIRST Offence): R5000.00. (SECOND Offence): NO Admission Of Guilt

7 read with 9 and 10 – Prohibition of standing in a public transport vehicle. Person standing in a public transport (FIRST Offence): R10000.00. (SECOND Offence): NO Admission Of Guilt

8(10-(4) read with 9 and 10 – Loading capacity of public transport during lockdown:
(1) A vehicle licensed to carry up to 4 passengers carrying more than one passenger (FIRST Offence): R2000.00. (SECOND Offence): NO Admission Of Guilt
(2) A minibus licensed to carry up to 8 passengers carrying more than 3 passengers (FIRST Offence): R5000.00. (SECOND Offence): NO Admission Of Guilt
(3) Minibuses not reducing seating capacity by 50% of ots seating capacity to mitigate the spread of the virus (FIRST Offence): R5000.00. (SECOND Offence): NO Admission Of Guilt
(4) Public transport operators not putting measures in place to adhere to social distancing to curb the spread of the virus (FIRST Offence): R5000.00. (SECOND Offence): NO Admission Of Guilt
