A victory (of sorts) for the little man

With reference to my little moan and groan about a disturbance of the peace by our neighbours – the Nelson Mandela Bay Stadium – on 24 October 2013, I am happy to report that the wheels within our municipality DO move quicker than any of you peasants thought…..

The Longhair received today the following feedback from the NMB Municipal Air Pollution/Noise Control division within the Public Health Directorate:

Following an investigation into the event of 24 October 2013 it was found that no application for a noise certificate was made to the municipality by the NMB Stadium management. This was due to a misunderstanding by them that no noise certificate was required for private functions. Evaluation of the noise measurements conducted by the stadium management on the night of the event, also revealed a disturbing noise caused in terms of the Noise Control By-law, which is an offence.

The requirements of the Noise Control By-law was pursued with the stadium management and confirmation was received by their CEO that all events, involving amplified sound and musical entertainment, and especially those staged outside of the stadium building, will be co-ordinated by the SAPS Events Planning Committee (EPC). This will ensure that proper conditions are set for compliance monitoring as a proactive approach towards compliance with applicable municipal legislation.

Kudos to Kobus and his team for following up and reporting back on their findings – this gives us great comfort that our rates are being used productively and sends a clear message that NO-ONE is above the law.

AND I want to quote from the above article which states; “… during my and the Longhair’s conversations with Chris and Jaco down at the NMB Stadium we were told by both that the guidelines given to them by the Municipality for the event was that the noise level was not allowed to exceed 65 decibels on the perimeter of the stadium. Both assured us that they had done readings which indicated 61 decibels.”

So Chris and Jaco were you actually strangers to the truth when you told/implied to us that you DID have permission from the Municipality?

And NOT ONE of our messages of concern to the stadium has been answered – sad, very sad!
