Why Ace and His Buddies Still Receive Their Salaries after ‘Step Aside’

12 May 2021 By Alan Straton

One is sure that this ‘news’ will not endear Ace to his many employees who are fearful of receiving salaries…

South African Labour Law acknowledges two types of suspension:

  1. The first type of suspension is a ‘holding operation’ where the suspension is not designed to impose discipline, but is rather for reasons of good administration.
  2. The second type of suspension serves as a form of disciplinary action.

In the case of Ace Magashule and his buddies the first type of suspension applies as their Employer has ‘suspended’ them pending the results of an ongoing criminal investigation. Although the wording used by the ANC is ‘step Aside’ so one may well see an argument by a clever lawyer that ‘step aside’ is actually without pay as it is not the result of a suspensive action OR Ace’s lawyers may go to the CCMA for unlawful dismissal not in terms of the Labour Act.

Only once the criminal investigation is concluded and, if the charges against Ace find him guilty THEN the employer can proceed with disciplinary action. Motivation enough for Ace to stall the criminal proceedings for as long as possible!

Apparently Mr Magashule’s monthly salary from the ANC is R133 000.00 per month as Secretary General.

Ace’s buddy, MP Bongani Bongo, who is currently paid R1 495 755 per annum, will now be enjoying his lavish Parliamentary salary from the comfort of home. As well as Members of Provincial Legislatures Zandile Gumede in KwaZulu-Natal and Sindiswa Gomba in the Eastern Cape, who both earn R1 101 348 per annum.
