The National Energy Regulator of South Africa (NERSA) is studying the judgment of the High Court to review and set aside its decision on Eskom’s fourth Multi-Year Price Determination (MYPD4) for the 2019/20, 2020/21 and 2021/22 financial years. “The judgment follows NERSA's acknowledgment of procedural unfairness in the MYPD4 decision concerning the inclusion of the R23 billion government grant without allowing Eskom to submit its representation, in line with the National Energy … [Read more...] about NERSA notes Eskom court judgment

Consumers lose when electricity regulator is weak
Eskom wins, but NERSA, electricity users and taxpayers lose, says OUTA South Africa needs an electricity regulator who can defend the public from rising electricity prices. This week the high court again found the National Energy Regulator (NERSA) wanting. NERSA is supposed to be the independent energy regulator with the skills and capacity to assess whether Eskom’s applications for tariff increases are rational and reasonable, and set a fair price for electricity. Although Eskom is … [Read more...] about Consumers lose when electricity regulator is weak

Consumers hit again with unfair high price increases
Eskom didn’t get the price increases it wanted, but OUTA believes it still received more than it deserves. This is also a decision which reflects the lack of a coherent strategy by Government on Eskom’s future and the pricing path, as NERSA apparently didn’t consider the effect of the R23bn-a-year bailout over the next three years. “We need Government to work in an integrated manner, we need a holistic direction from either the Presidency or the Department of Energy. Government is talking … [Read more...] about Consumers hit again with unfair high price increases

5.23% Eskom increase a bittersweet victory
The Organisation Undoing Tax Abuse (OUTA) salutes South Africans for their unprecedented participation in the public process which helped cut Eskom’s tariff increase down to 5.23%. This means the average price stays under R1/kWh. “This is a bittersweet victory for civil society. It’s much better than Eskom’s requested 19.9%, but we believe it should have got 0%,” says Ben Theron, OUTA’s Chief Operating Officer. “We cited an ongoing decline in efficiencies, maladministration and … [Read more...] about 5.23% Eskom increase a bittersweet victory

Business Chamber responds to Constitutional Court Ruling
We have taken cognisance of the Constitutional Court’s ruling yesterday (22 August) which upheld the SCA’s decision regarding the powers and functions of the electricity Regulator, Nersa, in relation to what we consider to be unreasonable electricity tariff hikes in South Africa. This decision relates to a Supreme Court of Appeal’s ruling earlier this year that affirmed the Regulator’s decision to allow Eskom’s application for a country-wide tariff adjustment. NERSA’s 2.2% Cap on Eskom Tariff Commended
OUTA has commended NERSA for rejecting Eskom's demands for a higher tariff increase and for sticking to the 2,2% allowed under the current Multi-Year Price Determination (MYPD) process. "We are appalled that Eskom has sighted current ‘hardships' as the reason for requesting a much higher increase, especially since these so-called hardships are self-inflicted and exist due to poor leadership – as reflected in the recent Dentons report," says Ted Blom, OUTA's Portfolio Director on Energy … [Read more...] about NERSA’s 2.2% Cap on Eskom Tariff Commended
