The Democratic Alliance (DA) calls for swift, decisive action against Nelson Mandela Bay Deputy Mayor, Cllr Gary van Niekerk, who faces serious allegations of cyber fraud and breaches of the Municipal Finance Management Act (MFMA).
Following a summons issued by the Hawks, Van Niekerk is set to appear in the Gqeberha Commercial Crimes Court next month. These allegations highlight an abuse of power and disregard for ethical governance within the municipality.
An ad hoc multiparty municipal committee recently concluded its investigation into these allegations. It determined that Van Niekerk violated the Code of Conduct for Councillors and breached provisions of the MFMA. The committee recommended that he be either suspended or removed from his position as a councillor.
The Hawks’ action to pursue charges against Van Niekerk affirms the DA’s longstanding position. We advocated for legal action when the allegations surfaced, alleging that Van Niekerk had engaged Boqwana Burns Incorporated in 2022 after his council seat was declared vacant.
During this period, he allegedly incurred a legal bill exceeding R550,000 by hiring the firm amid a legal dispute between factions within the National Alliance, the party he leads.
Throughout this period, the DA has consistently highlighted that, despite not being a councillor at the time, Van Niekerk allegedly misrepresented himself as having the authority to engage a service provider on behalf of the Counci
This act, if proven, contravenes laws that prohibit unauthorised persons, including councillors or former councillors, from appointing service providers or interfering with municipal Supply Chain processes.
We call on the Hawks to complete their investigation promptly and for the courts to act decisively. Should Van Niekerk be found guilty, accountability measures must be followed to restore integrity to his office.
The people of the metro deserve better. Corruption is a scourge that is undermining our country. We will do everything in our power to rid Nelson Mandela Bay of corrupt and compromised politicians and get it back on track.
