Dear MyPE
We have problems with the neighbours that make noise sometimes until 4:00 in the morning.
The police was previously contacted but it seems that they do nothing about it.
On the WEB PAGE the following number was for contacting noise pollution was given – 0800205050.
I contacted the number and my understanding from Mr Asa was that the department is not functioning from November.
He gave me a number 0794900829 Mr F. Hay to contact or to phone the police (I don’t know if the police have the equipment to to take noise pollution readings ). I tried to contact Mr Hay but there is no answer.
Who can be contacted if the bylaw for noise pollution is broken.
Regards
Hendrik
MyPE’s best advice is as follows, Hendrik:
- Read these articles: http://mype.co.za/new/noise-pollution-your-rights-as-a-neighbour-and-polluter/21675/2013/03 and http://mype.co.za/new/about-that-noise-on-saturday-night/21673/2013/03
- Speak to the Environmental Health Sub Directorate for advice – 041 506 1673 OR DIRECTLY to the Air Pollution/Noise Control Division on 041 506 5207
- Download a noise level meter onto your phone – it will give you a measure for the next point
- Remember always that a Disturbing Noise is defined as a noise level that exceeds the ambient sound level measured continuously at the same measuring point by 7 dBA or more. You will see with your noise level meter that 7 dBA is not a lot.
- Record the normal noise levels then record your neighbours (from the same spot). If you like you can send MyPE screen grabs of the two and we will publish.
- Contact your Ward Councillor and get him/her to escalate to the relevant authorities.
- The Metro Police will ultimately be the ones who attend to bye law complaints such as yours so ask your Ward Councillor to take your concern to John Best – Councillor for Safety and Security.
- I think you got the wrong information from 0800205050 – next time insist that they record your concern AND give you a reference number.
- Continue to engage your neighbour and point out to them the articles above that lay out your rights. Do NOT be combative but rather be PERSISTENT and notify your neighbour everytime of a transgression verbally and in writing.
- Enlist the help of other neighbours adversely affected by the noise and get them to also engage in a PERSISTENT manner – some people in this world need to be told something more than a hundred times before they learn anything unfortunately.
- You could also nominate your neighbour for a Darwin Award!
- I know some people who swear that a good dose of lead (delivered via a 9mm or other administration vessel of choice) does work – my advice on that score is make sure that you have piles and piles of personal, lawyers and other letters, affidavits and complaints to the SAPS before you decide to administer that form of medicine. You will need to prove that you were driven to your act by your neighbours actions …..
