Alert Level 3 implications for owners and residents living in complexes and rental buildings

2 June 2020 By Alan Straton

Andrew Schaefer, Managing Director of Trafalgar Property Management (Pty) Ltd clarifies Lockdown Level 3 for sectional title residents and tenants:

For ease of reference, I would like to summarise the relevant implications of Alert Level 3 for residents in community schemes.

From Monday 1st June 2020 the following gazetted regulations will directly impact residents in complexes:

  • Curfew: has been cancelled
  • Exercise: allowed on the common property and within the district from 06h00-18h00; may not be in organised groups and social distancing required. Pets may be exercised at the same time.
  • Common amenities: to remain closed
  • Maintenance services: all allowed to resume provided the necessary Covid-19 health and safety practices are complied with inside the complex. Same applies to construction projects.
  • Domestic workers and building staff: allowed to resume work provided that they comply with wearing a mask to and from work, sanitise on entering and leaving the complex, observe social distancing on the common property.
  • All persons on the common property should wear masks and should ensure there is social distancing.
  • Visitors: still no visitors allowed unless family members caring for the sick, disabled or children who have not been able to return to school.
  • Tenant moves: allowed subject to form 6 in the gazetted regulations being completed where inter-provincial travel is required. In all cases ensure that such moves are properly documented and new tenants/owners receive a briefing on COVID guidelines.
  • Estate agents: may show sale and rental units to prospective buyers and tenants, ideally by appointment and ensuring rules regarding social distancing, masks, etc are complied with.
  • Short term leasing (e.g. AirBnB): not allowed including for leisure / holiday purposes
  • Deliveries: allowed and should ideally be left at the guardhouse entrance, reception or other secure entrance point
  • AGMs and Trustee / Director meetings: still not allowed with only business meetings allowed at offices. Virtual meetings can be held subject to conditions. Where used, round robin resolutions for AGM business would require approval by all owners
  • Covid-19 Operational Plans and Compliance Officers: required for complexes which employ staff directly (e.g. cleaners and gardeners). Templates, training material and sample signage available on www.trafalgar.co.za/covid-19

Passionate about Port Elizabeth and definitely NOT packing for Perth. Alan's ethos is epitomised in the words of Nelson Mandela; "I have fought against white domination and I have fought against black domination. I have cherished the idea of a democratic and free society. If need be, it is an ideal for which I am prepared to die." See more articles by Alan.
